1.- Booking and contracting procedure

General Information

Welcome to Livensa Living Studios. You are about to live one of the best experiences that will allow you to grow as a person.

You will be part of a community of maximum tolerance and integration, where, above all and everyone, there is the respect for people, their beliefs, ideas and traditions.

At Livensa Living Studios we encourage socialization and learning from each other, in order to convert living together into something easy and healthy, enabling us to help each other and grow as community.

In the following Terms and Conditions (hereinafter “T&C”) you will find the legal conditions governing contracting our services. It is important for you to read and understand them as, by making a booking and signing our contract, you agree to be bound by these T&C.

We remind you that to book a room or contract any of the services offered through our Website, you must be of legal age and provide all the information and documents requested during the registration and contracting process, in order to access our properties.

In case you are underage, during the registration process, we will request information of your legal guardian and we will contact him/her to finalize the booking process in order to guarantee that you have the authorization to stay in one of our properties.

Notwithstanding the foregoing, you as the Client, must be over 16 years old on the start date of the contract. Otherwise, the agreement will be null and void and of no force and effect.

Once you have filled in the necessary information about the property you are interested in and confirmed availability, you will need to create an account with your profile using your email address and register in order to complete a booking.

Please note the email address you provide will be used to identify you and we will use it to send you the corresponding communications and the appropriate information of your booking during your entire stay. We therefore strongly encourage you to use an address that you use and consult regularly.

If there is no availability, a message will appear informing you and inviting you to select different dates, room type and/or building.

Once you have been through the above process and created your profile, you will be able to book a room and any additional services that may be available will be included and form part of your agreement. 

To finalise any booking or service, you must previously accept theseT&C, as well as the Privacy Policy, and then sign the corresponding contract.

By accepting them, your rights and obligations are expressly regulated, and you are acknowledging and declaring that you have read each and every one of the legal texts mentioned above and agree to be bound by them, following which the corresponding agreement is considered signed.

To complete the booking process and, depending on the length of the stay, you will have to pay the amounts indicated, as described below, either at the time of booking or in the periods indicated in each case. Once the booking process has been completed and the contract signed, we will send you an e-mail informing you that the request has been registered and the room reserved.

In case the payment of the appropriate amounts had not been made within forty-eight (48) hours from the signature of the agreement, your booking will be cancelled and the signed agreement will have no validity between the parties.

Please note that failure to make the relevant payments after signing the contract, in line with the payment terms stipulated in the agreement, may also result in the early termination of the agreement and cancellation of your booking.

 

MODIFICATION OR CANCELLATION OF THE BOOKING

In case you would like to modify or cancel a booking, please consult the applicable Cancellation Policy of Livensa Living Studios and Livensa Living below.

 

PAYMENT METHODS

The methods of payment accepted are:

  • SEPA zone
    • Payments available through the Flywire platform.
    • Direct debit payment.

*The SEPA area consists of thirty-six countries: the members of the European Economic Area (comprising the twenty-seven states of the European Union plus Liechtenstein, Iceland and Norway) and Andorra, Monaco, San Marino, Switzerland, United Kingdom and Vatican City State).

 

  • Other areas

The means of payment accepted for the formalisation of reservations will be those available on the Flywire platform, which may vary depending on the country you are in.

2.- Livensa Living Studios – Booking and cancellation Terms

The Booking and Cancellation policy shall apply to the following buildings in Spain:

  • Livensa Living Studios Bilbao
  • Livensa Living Studios Málaga
  • Livensa Living Studios San Sebastián
  • Livensa Living Studios Valencia Marina Real
  • Livensa Living Studios Valencia Viveros
  • Livensa Living Studios Madrid Alcobendas
Booking Policy

The Client can make a booking through our website, by the help of our Call Center by the telephone system, or through any other official platform in which Livensa Living Studios is offered.

When making a booking directly through our website, the Client must provide the identification data and make the payment of the corresponding amount by the means of payment specified above.

The amount to be paid at the time of the booking will vary depending on the duration of the stay and the start date of the Agreement.

You will find the information on when payment should be made in this T&C, at the time of contracting the room and in the Particular Conditions of the agreement.

Once the booking has been made and the corresponding amount has been paid, Livensa Living Studios will send you an email confirming the booking (Booking Confirmation Document). A booking request will not be considered accepted until you have received the Booking Confirmation Document.

In case of starting the booking process (pre-booking) but not making the payment of the corresponding amount within a period of 48 hours, the pre-booking will be without effect and will be understood as not made.

When making a booking through any platform not managed by Livensa, the Client must follow the steps defined by such platform to secure a booking.

Cancellation Policy

Cancellations must be communicated by sending an e-mail to [email protected] indicating the booking number, start date of to the contract and identification data of the person who made the booking:

The cancellation of a booking will result in the application of the following penalties:

Bookings of 30 days or less:

  1. May be cancelled without cost if cancellation request is communicated more than 45 days before the star date of the contract.
  2. For cancellations made less than 45 days in advance, the cancellation of the booking by the client will result in applying the following percentage as compensation:
  • 5% when the cancellation is communicated more than 30 days before the date of check-in.
  • 40%, if the cancellation is made between 30 days or less and more than 15 days.
  • 60%, if the cancellation is made between 15 or less days and more than 7 days.
  • 100% if the cancellation is made 7 days or less before the star date of the contract.

 

Bookings longer than 30 days, the following special cancellation conditions will apply:

  1. If a “special student rate has been applied to your contract (“Full Year”, “Academic Year” or “Semester” contracts), you must pay attention to the following conditions:

a.1. Prior to the start date of the Agreement

You may request the cancellation of the contract if, being a student:

(i) Your cancellation request is made no later than 14 days after the date of signing the Agreement. If the period between the date of your booking and the Start Date of the contract is less than 14 days, the cancellation for this reason will be only valid for the days remaining between the signing and the commencement of the contract (“the right of withdrawal”).

(ii) You were not admitted to the university/ educational institution in the province for which you made the booking. In this case, you must provide proof of enrolment in a different province.

(ii) Your visa application, for the period corresponding to the booking, has been refused by the Spanish authorities. The visa refusal document will be requested as proof.

In all these cases, the amounts already paid will be refunded.

If you are not in any of the above situations, you may request the cancellation of the contract if:

(iv) you, the Client, finds a person as a replacement, under the same conditions and type of contract you have, until at least the End Date of the Agreement.

This person shall not have signed an Agreement with us during the 12 months, nor be in the process of negotiation or having signed an Agreement for following 12 months. He or she shall also have the student status for the duration of stay.

(iv) The contract may also be cancelled if, with respect to the Agreed Period (counted by months), the Client pays 50% of the remaining amount of the Agreement, as compensation for the damage caused.

This penalty shall not be less than one (1) month nor more than three (3) months of the Housing Fee that was contracted.

In all these cases, you should send an email communicating your situation to [email protected].

a.2. After the start date of the Agreement and before the agreed period has expired.

You may request the cancellation of the contract if:

(i) Client finds a person as a replacement, under the same conditions and type of contract, until at least the End Date of the Agreement.

This person replacing the client shall meet the same requirements indicated in point a.1.(iv).

(ii) The contract may also be cancelled if, with respect to the Agreed Period (counted by months), the Client pays 50% of the remaining amount of the Agreement, as compensation for the damage caused.

  • You will have to pay in full the month which you leave the Studio, and
  • The penalty will be calculated considering the period remaining to complete the Agreement (End Date), excluding the month in which you leave the Studio.

This penalty shall not be less than one (1) month nor more than three (3) months of the Housing Fee that was contracted.

To manage these situations, once the contract has started, you must send a cancellation request to the email address of the building where you are hosted. Such email address may be found in the Particular Conditions of the signed agreement.

  1. If a “special monthly rate” has been applied (contracts for “Short Term”, “Mid Term” or “Long Term”):

Client may request the cancellation of the contract if:

(i) Client finds a person as a replacement, under the same conditions and type of contract, until at least the End Date of the Agreement.

This person shall not have signed an Agreement with us during the 12 months, nor be in the process of negotiation or having signed an Agreement for following 12 months.

(ii) The contract may also be cancelled if with respect to the Agreed Period (counted by months), the Client pays 50% of the remaining amount of the Agreement, as compensation for the damage caused.

This penalty shall not be less than one (1) month nor more than three (3) months of the Housing Fee that was contracted.

Important:

To manage these situations, Client must send a cancellation request to the email address [email protected], or, if accommodated, to the address of the building you are hosted.

In all above cases, it will be understood that the cancellation has been communicated when the email or notification has been sent before 12:00 noon on the day of reference. Any email or notification sent after 12.00 a.m. on the day of reference shall be deemed to have been communicated on the following day, and therefore, out of time.

All bookings are subject to availability. Livensa Living Studios reserves the right to reject a booking at any time, cancel it or not accept it, in the event that the payment information provided is not valid or if the security systems indicate that the reservation is anomalous or there is a risk that it is fraudulent and the client did not solve it.
